All bids must be received by J.C. Devine by Noon, Eastern Time, the Saturday proceeding the Auction Date. The property listed in this Auction will be offered and sold under the following Terms and Conditions.

1.In order to bid on anything in this sale, buyers must register and be assigned a buyers number. If previous credit has not been approved and you wish to pay by check, you must be approved by our credit department prior to sale.

2.Terms of sale are cash or check, Master Card, Visa or American Express at time of sale, ie: When you wish to leave, pay your bill at cashier, the receipted invoice is authorization to remove your goods from the hall. No goods may be removed from the hall until bill is paid in full.
J.C. Devine, Inc. reserves the right to demand payment in cash. Makers and passers of bad checks will be prosecuted to the fullest extent of the law. J.C. Devine, Inc. reserves the right to hold merchandise purchased by personal check until the check has cleared the bank, if such action is deemed necessary to protect its interest.

3.Description: Every effort is made by J.C. Devine, Inc. to describe articles being sold as accurately as possible. Our research includes consultation with outside experts and specialists in their field when determined necessary and extensive library research. However, we do not warrantee the authenticity, origin, condition, or date of manufacture.
Our printed descriptions are intended to be an aid and convenience to buyers. All descriptions are subject to errors and omissions. All Sales are Final. Please note: J.C. Devine, Inc. will sincerely consider any reasonable request for a refund if a written opinion by an approved authority is submitted to the auctioneer along with the purchased property in the same condition as sold within 30 days of date of auction that proves the description be predominately erroneous. The experience and reputation of J.C. Devine, Inc. is in every description, and we will be the sole judge in matters of refund.

4.The highest bidder acknowledged by the Auctioneer shall be the purchaser, and shall be considered to be the owner of record at the fall of the hammer. In the event of any dispute between bidders, the Auctioneer will have absolute discretion as to who was the successful bidder.

5.The Auctioneer reserves the right to reject any bid or raise not commensurate with the value of the article being offered.

6.Absentee bids: As a convenience to the buyers who cannot be at the sale, absentee bids will be accepted with a 20% deposit*, unless prior credit approval has been established. The desk will bid in absentee order bids. (See instructions to order bidders and order bid form).

7.The numbers in the lower right margin after each description (pre-sale estimate) mean nothing other than the researchers opinion (or guess) at what the article will bring at public auction. This pre-sale estimate is meant as a guide or a grading tool for the buyer.

8.A Buyer's Premium of 17.5% will be charged on all sales, however a 2.5% discount is offered if paid by cash or check. The buyer's premium is paid by the purchaser in addition to the bid price.

9.Mastercard, Visa and American Express are accepted forms of payment for catalogs, auction purchases for persons attending the auction, as well as absentee bid deposits. Absentee bidders cannot pay for their purchases in this manner.

10.All Absentee bidder's goods will be shipped as soon as possible after receipt of payment. Shipping charges are the responsibility of the bidder.

11.Any article which has an asterisk (*) after the article number is an antique or modern black powder muzzle loading gun, and is not subject to Modern Firearm Laws.

12.Bidding on any article(s) indicates your acceptance of these terms in their entirety.

I understand that J.C. Devine, Inc. will execute my bids as a convenience and will not be held responsible for any errors or failure to execute bids. I understand my bids are placed subject to the Terms and Conditions of Sale and that I am responsible for the entire purchase price less my deposit, plus any shipping cost. Shipment will be made as soon as possible after full payment has been received.
